License Agreement

Ext End User License Agreement

Version 1.0, April 29, 2004

This is a legal agreement ("Agreement") between you ("Licensee", either an individual or a single entity) and the Max-Planck-Gesellschaft z.F.d.W., represented by the Max-Planck-Institut für Informatik ("MPII").
Please read the following Agreement carefully.
By clicking on "[accept]" or by downloading or installing the Ext software you indicate that you read and accept the provisions of the Agreement and that you agree to be bound by all terms and conditions set forth herein.
If you do not agree to the terms of this Agreement, decline where indicated, and do not download, install, copy or otherwise use the Software.

1. Copyright

The Ext Software contains source code that is taken from LEDA, a software library maintained by Algorithmic Solutions Software GmbH ("Algorithmic Solutions").
The Ext software, including but not limited to the code, sample programs, any associated files and documentations ("Software"), is partly owned by MPII and partly owned by Algorithmic Solutions. The software is protected by copyright laws.
Algorithmic Solutions grants MPII the right to modify, use and include the LEDA data type real in the Ext package and to distribute the package under the following research license:

2. Research License

The research version of the Software is a free full-working copy of the commercial version of the Software.
The Research License grants Licensee the non-exclusive and non-transferable right to install and use the Software.
The Licensee may not rent, lease, sell, sublicense, redistribute, lend or otherwise transfer the Software or any portion thereof if not expressly allowed in the stipulations of this Agreement.
The Research License is subject to the following restrictions: Any commercial use of the Software or any use by a commercial institution requires the possession of a commercial license of the Software, available at:

3. Limitation of Warranty and Liability

The Software is licensed to the Licensee on an "AS IS" basis.
Except as expressly provided herein, MPII makes no other warranties, either Express or Implied, regarding the program, its merchantability or its fitness for any particular purpose.
The Licensee takes note of the fact that the Software is neither developed nor intended for high risk activities such as in the operation of nuclear facilities, aircraft navigation, traffic control, direct life support machines, or weapon systems, in which the failure of the software could lead directly to death, personal injury, or severe physical or environmental damage. Any liability therefore is excluded.
In no event will MPII be liable for any damages, including but not limited to any loss of revenue, profit, or data, however caused, directly or indirectly, by the Software or by this Agreement.

4. Delivery

The Software is obtained via Internet download.

5. Distribution

No distribution is to be made of the Software by the Licensee.

6. Termination

If the Licensee fails to comply with any term of this Agreement, this Agreement is terminated and the Licensee has no further right to use the Software.
On termination, the Licensee shall have no claim on or arising from the Software.
The Software and any copies shall be destroyed.
The Software is not available to those not permitted by laws to have access to the Software.

Legal domicile

This Agreement is made and shall be construed in accordance with the laws of Germany.

7. Entire Agreement

This Agreement constitutes the entire agreement between the Licensee and MPII. It replaces all other representations All modifications or extensions of this Agreement need to be put down in writing.

8. Construction clause

If for any reason a court of competent jurisdiction finds any provision of this Agreement, or portion thereof, to be unenforceable, that provision of the Agreement will be enforced to the maximum extent permissible so as to affect the intent of the parties, and the remainder of this Agreement will continue in full force and effect.
